HZ Tutoring PTY LTD – Terms & Conditions 06/05/2025
- Tutors and Tutoring Services
1.1 Tutors contracted by HZ Tutoring are independent contractors. When engaging a Tutor, Students directly enter into a contractual agreement with the Tutor. HZ Tutoring acts solely as an intermediary to facilitate connections between Students and Tutors.
1.2 Tutors must meet minimum qualifications and standards set by HZ Tutoring. HZ Tutoring reserves the right to terminate the engagement of any Tutor who ceases to meet these standards, at its sole discretion.
1.3 HZ Tutoring assesses prospective Tutors based on their application information. While we occasionally verify credentials or conduct interviews, HZ Tutoring holds no obligation for comprehensive background checks. Students acknowledge inherent risks in private tutoring and expressly release and indemnify HZ Tutoring from related loss, injury, or damage.
1.4 Tutors, by working with HZ Tutoring, affirm that:
- All provided information is accurate and complete;
- They possess a valid Working with Children Check if tutoring minors;
- They are eligible to work in Australia and comply with all relevant tax obligations;
- They agree to a fixed hourly rate as determined by HZ Tutoring unless otherwise arranged.
1.5 HZ Tutoring does not guarantee the volume or continuity of tutoring assignments.
1.6 Tutors are responsible for managing their own tax obligations, including income tax, GST, and other applicable taxes.
- HZ Tutoring Role and Obligations
2.1 HZ Tutoring aims to match Students with appropriate Tutors based on their preferences but assumes no responsibility for the conduct of Students, parents, or Tutors once matched.
2.2 HZ Tutoring reserves the right to suspend or terminate any tutoring relationship if a party’s conduct is deemed detrimental to HZ Tutoring.
- Lessons, Fees, and Payment
3.1 Payment for tutoring sessions is charged hourly at the rates listed on the HZ Tutoring website unless otherwise agreed.
3.2 Invoices are issued weekly via email and Tutorbird, payable within 7 days through Direct Debit via Stripe.
3.3 All financial transactions occur directly through HZ Tutoring. Direct payments between families and tutors are strictly prohibited.
3.4 HZ Tutoring may temporarily suspend tutoring services if payments are overdue by more than 45 days. If payment remains outstanding without communication, the account will be referred to a debt collection agency such as Marshall Freeman. HZ Tutoring may also charge late payment fees, interest, legal, and recovery costs as defined within these Terms of Service for accounts not paid within the agreed credit terms.
- Logging Lessons and Solicitation
4.1 Users must not solicit or arrange tutoring services outside of HZ Tutoring’s system to bypass our fee structure.
4.2 Breaches of this condition will incur a penalty of $500 per instance.
- Cancellation Policy
5.1 If lessons are cancelled with less than 1 hour’s notice, or in cases of no-show without valid reason, you may be billed half the session’s cost.
5.2 Cancellation notice must be provided directly to the Tutor.
- First Session Satisfaction Guarantee
5.1 If dissatisfied with your initial session, notify HZ Tutoring immediately, and we will arrange a complimentary session with an alternative Tutor.
5.2 Notification of dissatisfaction must occur immediately after the initial session.
- Intellectual Property
6.1 All intellectual property rights relating to HZ Tutoring materials remain with HZ Tutoring.
- Confidential Information
7.1 Users agree to keep all confidential information from HZ Tutoring private and not disclose it to third parties.
- Termination
8.1 Either party may terminate the tutoring relationship at any time.
- Indemnity and Liability
9.1 Tutors indemnify HZ Tutoring against any loss, damage, or liability arising from their acts or omissions.
9.2 HZ Tutoring is not liable for consequential losses related to tutoring services.
- Governing Law
9.1 This agreement is governed by the laws of Victoria, Australia.
- Modifications
10.1 HZ Tutoring reserves the right to modify these Terms & Conditions at any time with notice provided via the HZ Tutoring website.
